West Northamptonshire resident prosecuted for repeated fly tipping

West Northamptonshire Council has successfully prosecuted a local resident for repeated fly tipping in Northampton.
Between July 2024 and July 2025 officers from West Northamptonshire Council’s Environmental Crime Team investigated six large fly tips on East Street, Northampton.
During the investigation evidence linking each fly tip to Maria Irina Notar was found. Throughout the investigation, she failed to communicate or engage with the Environmental Crime Team.
On 22 September 2026 Ms Notar formally of East Street, Northampton now of Countess Road, Northampton, attended Wellingborough Magistrates Court where she pleaded guilty to six offences under section 34(2A) the Environmental Act 1990 for failing in her duty to ensure waste from her property was transferred to an authorised person.
The court imposed a fine of £615, victim surcharge of £250 and ordered the Council’s costs of £2,345.05 to be paid. The case was prosecuted by Ronald Sempebwa from West Northamptonshire Council’s in-house Legal Services team.
Under Section 34 of the Environmental Protection Act 1990, individuals are legally responsible for their household waste until it is properly disposed of, even if they hire someone else to take it away.
Cllr Andrew Last – Cabinet Member for HR, Corporate and Regulatory Services said: “Fly tipping is totally unacceptable, a huge problem for all councils and we fully understand the impact it has on our residents and local businesses.
“This case sends a warning to local residents who may be tempted to fly tip and a reminder to those looking to deposit their waste that even if you hire someone to take it away you remain legally responsible for it and could be liable for a fine or prosecution if it ends up being illegally deposited.
“Please dispose of your waste responsibly by ensuring you use a registered waste collection service, a legitimate a skip company, or our bulky waste service, or alternatively you can take it to a Household Waste Recycling Centre (HWRC).
“We would encourage residents and businesses to report fly tipping to us via our app or the website so we can investigate. With sufficient evidence we will always take action against offenders, so please share with us any footage from doorbell cameras, CCTV or dashcams that might help identify offenders.”
