If you are unhappy following your school appeal
If your appeal is unsuccessful there is no further right of appeal.
If you feel your appeal was not properly or fairly conducted, there are steps you can take.
You can write to the Appeals Manager to explain the alleged flaw at:
West Northamptonshire Council
Democratic Services
One Angel Square
Angel Street
Northampton
NN1 1ED
Alternatively, you can:
An officer will investigate and respond to you in writing to inform you whether your allegation justifies offering you a fresh appeal.
You cannot make a complaint because you do not agree with the Appeal Panel’s decision, but you can complain about the way the appeal was carried out.
If you feel your appeal hearing was not heard properly
If you feel your appeal hearing was not heard properly, you can complain to the:
- Local Government and Social Care Ombudsman (LGSCO), if the school you appealed for is maintained by the Council
- Department for Education (DfE), if the school is an academy or free school
Even though you may not be satisfied with the Appeal Panel’s decision, the LGSCO and DfE can only investigate whether there has been a failure to follow correct procedures, or a maladministration.
An Appeal Panel’s decision can only be overturned by the courts where a parent or admission authority is successful in applying for judicial review of that decision. You will need legal advice, at your own cost if you seek judicial review.
