Request a review of a premises licence

Request a review of a premises licence or club premises certificate if serious or ongoing problems have not been resolved through other enforcement action

You can ask us to review a premises licence or club premises certificate if there are serious or ongoing concerns about how the premises operates.

Reviews can be requested by:

  • responsible authorities
  • local residents
  • businesses affected by the premises
  • other people affected by the premises

A licence review should be a last resort. Before applying, you should consider reporting the problem to us or discussing the issue with a responsible authority.

When to request a review

You should only request a review where there is evidence that the premises is failing to promote one or more of the licensing objectives:

  • prevention of crime and disorder
  • public safety
  • prevention of public nuisance
  • protection of children from harm

Examples may include:

  • repeated breaches of licence conditions
  • persistent nuisance linked to the premises
  • ongoing crime, disorder or public safety concerns

We may reject applications that do not relate to one or more of the licensing objectives.

How to request a review

To request a review, you must complete the review application form, you can submit your application using our online form.

Once you have completed the form, send a copy of the application to the premises licence holder and the responsible authorities on the same day.

There is no fee for requesting a review.

Reviews cannot be requested anonymously.

Supporting evidence

You should provide as much evidence as possible, such as:

  • photographs or video recordings
  • sound recordings
  • incident diaries
  • records of complaints made to other organisations
  • witness statements
  • statements from neighbours or other affected people

Petitions

We can accept petitions as supporting evidence.

Petitions must:

  • include the names and addresses of all signatories
  • make clear that the process is not anonymous
  • identify a spokesperson who will act as the main contact
  • explain how the concerns relate to one or more licensing objectives
  • be submitted with a completed review application form

What happens after you apply

If your application is valid, we will advertise the review for 28 days.

Notice of the review will be published:

During this period, responsible authorities and other interested parties can submit representations.

Once the consultation period has ended, a Licensing Sub-Committee hearing will be arranged.

Review hearings are normally held in public.

All relevant representations and evidence will be included in a report for the Licensing Sub-Committee.

The report will include:

  • representations received
  • supporting evidence
  • names and addresses of those making representations

Other contact details will not be published.

The report will be available on the council website before the hearing. Reports, meeting minutes and recordings form part of the public record and may remain available after the hearing.

Before submitting evidence, make sure you are happy for its contents to be considered as part of a public process.

Possible outcomes

After considering the evidence, the Licensing Sub-Committee may decide to:

  • take no action
  • add, remove or amend licence conditions
  • remove a licensable activity from the licence
  • remove the designated premises supervisor
  • suspend the licence for up to 3 months
  • revoke the licence

After the hearing

We will write to you with the decision.

If you are unhappy with the outcome, you may have the right to appeal.
